Terms of Use
1. Introduction
1.1. "DABS" ("we," "us," or "our") operates an e-commerce platform consisting of a website and/or mobile application (the "Site") through which we sell fragrance products directly to customers.
1.2. These Terms of Use ("Terms") apply to all visitors and customers of the Site and govern your use of the Site and related services.
1.3. By using our Site, you accept these Terms in full. If you disagree with these Terms, in whole or in part, you must not use our Site.
1.4. If you use our Site on behalf of a business or organization, you confirm that you have the authority to bind that business or organization to these Terms, and references to "you" in these Terms shall include both you individually and that business or organization.
2. Registration and Account
2.1. You must be at least 18 years of age to register an account or place an order on the Site. By using the Site, you represent that you are at least 18 years old.
2.2. If you create an account, you agree to:
- Keep your password confidential;
- Notify us immediately if you become aware of any unauthorized use of your account; and
- Be responsible for all activity on your account, and accept that you may be liable for losses arising from any failure to keep your login details secure.
2.3. Your account is for your personal use only and must not be transferred to any third party.
2.4. We may suspend, edit, or cancel your account at any time at our discretion. If we cancel an order you've already paid for through no fault of your own, we will issue a refund in accordance with our Returns & Exchanges policy.
2.5. You may close your account at any time by contacting us.
3. Products and Orders
3.1. All fragrances sold on the Site are 100% original and authentic, sourced directly from brands or authorized distributors.
3.2. Product prices are as stated on the Site at the time of your order and are inclusive of all applicable taxes unless otherwise stated.
3.3. Delivery charges will be clearly stated at checkout before you complete your purchase, in line with our Shipping & Delivery policy.
3.4. A contract of sale is formed between you and DABS once your order is confirmed and payment is received. We reserve the right to decline or cancel any order, for example where a product is out of stock, priced incorrectly, or where we suspect fraudulent activity, in which case you will be notified and refunded in full for that order.
3.5. We take reasonable care to ensure that product descriptions, images, and prices on the Site are accurate and up to date, but we do not guarantee that all information is error-free at all times.
4. Delivery, Returns, and Refunds
4.1. Delivery of orders is governed by our Shipping & Delivery policy, available on the Site.
4.2. Returns, exchanges, and refunds are governed by our Returns & Exchanges policy, available on the Site.
4.3. We may update these policies from time to time. Changes will apply to orders placed after the date the update is published on the Site.
5. Payments
5.1. Payments must be made using the payment methods available on the Site at checkout.
5.2. We take reasonable measures to ensure that payments made through the Site are processed securely, but you acknowledge that no method of electronic transmission or storage is completely secure.
6. Promotions and Store Credit
6.1. Any promotions, discounts, or store credit offered by DABS will be subject to specific terms communicated at the time of the offer, which form part of these Terms.
6.2. We reserve the right to withdraw or amend any promotion or store credit at our discretion, including where we suspect misuse or fraud.
7. Rules About Your Content
7.1. "Your content" means any reviews, comments, feedback, images, or other material you submit to the Site.
7.2. Your content must be accurate, truthful, and must not:
- Be offensive, obscene, indecent, or sexually explicit;
- Be defamatory, threatening, abusive, harassing, or discriminatory;
- Infringe any third party's intellectual property, privacy, or other legal rights;

- Constitute spam or unsolicited advertising.
7.3. We may review, edit, or remove any content submitted to the Site at our discretion, including where we believe it breaches these Terms.
7.4. By submitting content to the Site, you grant DABS a worldwide, royalty-free, non-exclusive license to use, reproduce, publish, and display that content on the Site and across our marketing channels.
8. Use of the Site
8.1. You may view, browse, and print pages from the Site for personal, non-commercial use only.
8.2. You must not:
- Copy, republish, sell, or redistribute material from the Site without our permission;
- Use any automated system (bots, scrapers, etc.) to access or extract data from the Site without our written consent;
- Attempt to hack, disrupt, or impair the security or performance of the Site;
- Upload viruses, malware, or other harmful code to the Site; or
- Use the Site for any unlawful or fraudulent purpose.
8.3. We may suspend or restrict access to the Site at any time, including for maintenance or updates.
9. Intellectual Property
9.1. All content on the Site including text, images, logos, and design is owned by or licensed to DABS and is protected by copyright and other intellectual property laws.
9.2. The DABS name and logo are trademarks of DABS. You may not use them without our prior written permission.
9.3. Third-party trademarks (including fragrance brand names) referenced on the Site belong to their respective owners. DABS is an authorized retailer of these products but is not affiliated with or endorsed by the brand owners unless expressly stated.
10. Data Privacy
10.1. Your personal data will be processed in accordance with our Privacy Policy, available on the Site.
10.2. By using the Site, you consent to the collection and use of your data as described in our Privacy Policy.
11. Limitation of Liability
11.1. Nothing in these Terms limits any liability that cannot be excluded under applicable law.
11.2. To the maximum extent permitted by law, DABS will not be liable for:
- Losses arising from events beyond our reasonable control (including force majeure events such as natural disasters, strikes, or system failures);
- Indirect or consequential losses, including loss of profits, income, or business opportunity; or
- Losses arising from your misuse of the Site.
11.3. Our total liability to you in respect of any single order shall not exceed the amount you paid for that order.
11.4. We do not exclude or limit liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under applicable law.
12. Indemnification
12.1. You agree to indemnify DABS against any losses, costs, or expenses arising from your breach of these Terms or your misuse of the Site.
13. Breach of These Terms
13.1. If you breach these Terms, we may, at our discretion:
- Suspend or terminate your access to the Site;
- Suspend or delete your account;
- Cancel any pending orders associated with your account; and/or
- Take legal action where necessary.
14. Changes to These Terms
14.1. We may update these Terms from time to time. Changes will take effect once published on the Site, and your continued use of the Site after publication constitutes acceptance of the updated Terms.
15. Entire Agreement
15.1. These Terms, together with our Shipping & Delivery policy, Returns & Exchanges policy, and Privacy Policy, constitute the entire agreement between you and DABS regarding your use of the Site.
16. Severability
16.1. If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue in full effect.
17. Governing Law
17.1. These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria.
17.2. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Nigeria.
